Wyandotte Attorney Is at Center of Lawsuit Alleging Movie Theaters Charge Too Much for Refreshments
Joshua Thompson and his lawyer, Kerry Morgan, are suing AMC over high cost of Coke and candy.
Is there a problem when a drink and a tub of popcorn cost more at the local movie theater than the ticket price itself?
Or, are customers who choose to buy snacks agreeing to the prices being charged every time they open up their wallets and voluntarily fork over the cash?
Joshua Thompson is ready to let a judge decide.
He and his Wyandotte attorney, Kerry Morgan, are suing the Livonia AMC theater after Thompson said he felt cheated out of being charged $8 for a Coke and box of candy in December.
"He got tired of being taken advantage of," Morgan told the Detroit Free Press. "It's hard to justify prices that are three- and four-times higher than anywhere else."
Thompson's lawsuit is seeking class-action status, whereas others who felt victimized by theaters' high prices could join the suit in hopes of getting some of their snack money refunded. The suit also is seeking a civil penalty to be levied against AMC.
Other lawyers said they doubt the suit will go anywhere, but it's definitely gotten people talking about the subject. Everyone, that is, except for AMC officials who declined comment on the suit.
Movie theaters typically make about a quarter of their entire operating revenue from concession sales, according to Smart Money.
In an effort to defend theater owners' right to charge what they want for snacks, a representative from the National Association of Theater Owners told Smart Money that it's "not a requirement" to buy popcorn when you go to the movies and that "people who want concessions can order them or not."

Businesses can (and do) charge what they want. Did anyone force this person to buy the popcorn? If you don't like the prices, don't go to the movies, that's what I do. Ridiculous.....

We all get upset when we see gas stations "price gouging" isn't this the same thing. A box of candy is $1.25 at Walgreen and at least $4.00 at the movies.

One thing for sure they don't treat their customers fairly when it comes to prices at the concession stand. I went to the movies Sunday morning and the ticket taker was just there no customer service at all,she ripped my ticket in half and pointed the direction of the theater. Why not welcome me to AMC Theaters and tell me to enjoy the show. I'm on the bubble as far as whether it is their fault for charging too much for concessions or the customers fault for buying the stuff at 4 times the price or both at fault because if nobody bought anything surely the prices would go down. They are there to make money but they are basically over charging you for
every thing you buy not just certain stuff. Do I think $3.25 is too much for a bottle of water that they pay 20 cents for sure it is. 1600% profit is a bit too much don't you thinkThe main reason they get away with it in court is nobody is forcing you to buy stuff when you go there and for that fact nobody is forcing you to even go to the movies in the first place. Bottom line it is your choice where and how much you spend when you go there or you can smuggle your concessions in your coat or purse. I did see a guy get caught bringing in a old popcorn bag and they caught him at the ticket station. I wonder how long he got away with getting free refills on popcorn. This was an older gentleman.$5.75 for all you can eat the rest of your life popcorn.It's sad that a business has to do this to survive all at their customers expense

BYOC! (Bring your own candy). Just make sure you don't smuggle in chocolate in your pants pocket. If he's successful maybe he can do something about the price of beer at the sporting events or what the airlines charge for luggage, or the price of a steak dinner at some restaurants, or what my dentist charges for a crown. Today AMC, tomorrow the world.

Beer at $8+ at sporting events is high but there is always a line to get it. How about Mike Illitch charging $5 for a Hot N Ready at the Little Caesars stores but at the ball park it is $14.50 maybe he should attach that in the lawsuit too.

Let's get a petition going to submit to Obama. Maybe he will dictate that all movie theaters must give free popcorn to all attendees. It may not be in the Constitution but who cares.

Sam the millions they pay in taxes isn't enough lets tax them more and more and more so they can't afford to give us peons jobs anymore. That seems fair doesn't it. You have got to be kidding me!!! Please tell me this is just a joke and our courts and justice system isn't seriously being 'victimized' by this frivolous hodge-podge. The only way I would even consider that such a lawsuit was justified is if purchasing items from the concession stand was a requirement to watch the movie. It's not even necessary to stuff your face full of junk in order to enjoy a movie. 80% of the time I go to the movies I don't purchase anything from the concession stand at all. AMC offers certain movie times at discounted and even free at certain times/days. They can make up for it by charging a little more at the concession stand. This lawsuit is only going to force AMC to charge more per movie ticket in order to pay for the lawsuit and unfortunately if a foolish judge rules, force them to lower their concession stand prices. Unbelievable!

I'm on the fence with this one, I do think that the movie theaters have been charging outrageous prices for concessions for years, but I usually bring my taco bell in to eat while I am watching the movie. I knew plenty of theater employees who also brought in their own food.

The movie theatre is a private owned business. How anyone thinks it's ok to bring in food items from another business it beyond me. That is just plain wrong. That would be like buying food from McDonalds or Big Boys then take it over to eat inside Portofinos because their food is so ridiculously high. One of the reasons the food is so expensive at Portofinos is because of the view on the water and the atmosphere inside. Now with movie theatres, they're a business to make money. Would you rather they raise ticket prices, or rather have low ticket prices and make up for it by charging more at the concession stand? I'm a smart consumer and I'd rather they charge less for the tickets, that way I can still 'afford' to go see a movie. I do agree the prices at the concession are very high, and that is why I often don't purchase any. There are discounted coupons and their rewards program, I've gotten free pop and popcorn with that. I'm sorry but to me this is not an issue to make big of. I happen to think the way it is now is the better way.

Very well put, Christine. There is no minimum purchase requirement at theater concession stands, so I think this fuss is crazy. I go to the theater frequently. Generally I'll eat/drink before I go to keep my cost down, but sometimes I patronize the stand because I'm glad their profits help keep the ticket prices down.

Does anybody think the prices are fair to the consumer? I thgink we all better start worrying about gas prices and what it is going to do to our economy when it hits $5 a gallon. This concession thing is going to be a non factor when that happens by mid summer. The energy secretary is not worried about it. That seems strange. If I was in office he would be looking for a new job. Why isn't everybody up in arms like they were when Bush was in office. They complained about high gas prices now that Obama is in there it seems it is not that big of a deal. Wake up America and get with the program. I guarantee most spend more on gas than at the movies including pop,candy and popcorn. It sucks what this world we live in has come to. But again nobody makes you go to the theater and nobody makes you buy concessions.
